These Terms govern your use of our website, the purchase of our products and services, and your use of our Hosting and Maintenance plans and Soar CRM platform. By using our website or making a purchase, you agree to these Terms.
Welcome to Worcester County Web Design LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website at wcwebdesign.com (“Website”), your purchase of any products or services, and your use of any platforms provided by us, including our Soar CRM platform and WordPress Hosting and Maintenance plans.
By accessing or using our Website, placing an order, or subscribing to any service, you agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase any services.
Worcester County Web Design LLC offers the following products and services:
Custom Website Design: Fully custom WordPress websites built in Elementor Pro.
Template Websites: Pre-built premium WordPress template websites with full setup included.
WordPress Hosting and Maintenance Plans: Recurring monthly managed hosting plans available in three tiers: Starter at $129 per month, Established at $349 per month, and Advanced at $699 per month. Each plan includes managed WordPress hosting, security monitoring, updates, backups, and support as described on our pricing page.
Soar CRM Platform: A monthly subscription to our branded customer relationship management platform, priced at $97 per month, including a 14-day free trial for new subscribers.
Descriptions, pricing, and availability of all products and services are subject to change at any time without notice.
You may use this Website for informational and transactional purposes. You agree not to use the Website for any unlawful or prohibited activity, including but not limited to:
All purchases made through our Website are processed securely via Stripe through our WooCommerce-powered store. By completing a purchase, you represent that you are authorized to use the payment method provided, that the billing information you supply is accurate and complete, and that you are at least 18 years of age or have the consent of a legal guardian.
All prices are listed in U.S. dollars. Applicable sales tax may be calculated and added at checkout in accordance with your billing location. Sales tax is automated through Stripe Tax.
Certain services, including WordPress Hosting and Maintenance plans and the Soar CRM platform, are offered as recurring monthly subscriptions.
By subscribing to a recurring plan, you authorize Worcester County Web Design LLC to charge your payment method on a monthly basis on the same date as your initial purchase until you cancel.
Soar CRM Free Trial: A 14-day free trial is available to new Soar CRM subscribers. No charge is applied during the trial period. After the trial ends, your subscription automatically begins billing at $97 per month. You may cancel before the trial period ends to avoid any charges.
You may cancel a subscription at any time by contacting us through our contact form at wcwebdesign.com/contact/ or through your account portal at wcwebdesign.com/my-account/. Cancellations take effect at the end of the current billing period. You retain access to the service through the end of the period for which you have been charged.
For Hosting and Maintenance plans, please provide at least 30 days advance notice before your next billing date to ensure a clean cancellation and proper data handling.
Upon cancellation of a Hosting and Maintenance plan, we will provide reasonable assistance migrating your website to a new hosting provider upon request. Website data is retained for 30 days following cancellation before deletion.
Template Websites: Refunds are not available once setup work has begun. If you cancel before any setup work has started, a full refund will be issued within 7 business days.
Custom Website Design: A deposit of 50% of the agreed project price is required to begin work. This deposit is non-refundable once work has commenced. The remaining balance is due on the launch date. If you cancel a project after work has begun, you are responsible for payment for all work completed through the cancellation date.
Hosting and Maintenance Plans: No refunds are issued for the current billing period following cancellation. You retain access through the end of the paid period.
Soar CRM Platform: No refunds are issued for partial billing periods. The 14-day free trial provides an adequate opportunity to evaluate the platform before committing to a paid subscription.
Exceptions may be made at our sole discretion in cases of documented technical failure or billing errors. Contact us at wcwebdesign.com/contact/ to request a review.
The following additional terms apply to custom website design engagements.
Project Commencement: Work begins upon receipt of the 50% deposit and execution of a project agreement.
Client Responsibilities: The client is responsible for providing all necessary content including text, images, logos, and other assets in a timely manner. Delays caused by late content delivery may extend the project timeline and do not entitle the client to a refund or price reduction.
Revisions: The number of revision rounds included is specified in your project agreement. Additional revisions beyond the agreed scope may be billed at our standard hourly rate.
Ownership: Upon receipt of final payment in full, the client receives complete ownership of the delivered website including all design files and code. Worcester County Web Design LLC retains the right to display the completed work in its portfolio unless otherwise agreed in writing.
Post-Launch Support: All custom website projects include 30 days of post-launch support for bug fixes and minor adjustments. Support requests outside this window are billed separately.
Third-Party Platforms: Websites are built on WordPress using Elementor Pro. Ongoing licensing, compatibility, and updates of third-party plugins are the client’s responsibility unless covered under an active Hosting and Maintenance plan.
The following additional terms apply to Hosting and Maintenance plan subscribers.
Content Updates: Plans that include monthly content update hours cover text, image, and basic layout changes to existing pages. Content updates do not include custom development, creation of new pages, or plugin configuration. Unused hours do not roll over from one month to the next.
Uptime: We use enterprise-grade managed WordPress hosting infrastructure and maintain reasonable commercial efforts to maximize uptime. However, we do not guarantee 100% uptime and are not liable for losses resulting from planned or unplanned downtime.
Security: We implement reasonable security measures including SSL certificates, managed firewalls on applicable plans, and daily backups. We are not responsible for security breaches resulting from vulnerabilities in third-party plugins, themes, or software installed outside our management scope.
Backups: Daily backups are included in all plans. In the event of data loss, we will make reasonable efforts to restore from the most recent available backup. We are not liable for any loss of data, content, or revenue resulting from a failed or incomplete restoration.
The following additional terms apply to Soar CRM subscribers.
Platform Availability: The Soar CRM platform is operated in part through third-party infrastructure. We make reasonable commercial efforts to ensure availability but do not guarantee uninterrupted access. Scheduled maintenance windows may result in temporary service interruptions with reasonable advance notice where possible.
Your Data: All contact records, pipelines, automations, and content you create within the Soar CRM platform belong to you. After 30 days, data may be permanently deleted.
Acceptable Use: You agree to use the Soar CRM platform only for lawful business purposes and in full compliance with applicable anti-spam, telecommunications, and data protection laws, including the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA). You are solely responsible for ensuring your email and SMS marketing activities comply with all applicable laws and regulations.
Resale Prohibited: You may not resell, sublicense, or otherwise provide access to the Soar CRM platform to third parties without prior written consent from Worcester County Web Design LLC.
All content on this Website, including but not limited to text, graphics, logos, design elements, and code, is the property of Worcester County Web Design LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
The Soar CRM name and associated branding are proprietary to Worcester County Web Design LLC. Third-party software, tools, and platforms referenced or integrated into our services remain the intellectual property of their respective owners.
By submitting information through our contact forms, checkout, or any other input on this Website, you represent that the information is accurate and that you have the right to provide it. You agree not to submit confidential, proprietary, illegal, or harmful material. Submissions through contact forms do not create a client relationship or obligate us to respond.
This Website and all products and services offered by Worcester County Web Design LLC are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, or reliability of any content on this Website. Use of the Website and our services is at your own risk.
To the fullest extent permitted by applicable law, Worcester County Web Design LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Website, our services, or any linked content. This includes but is not limited to damages for loss of profits, business, revenue, data, or goodwill. Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid to us in the 90 days preceding the claim.
This Website and our services integrate with third-party platforms including but not limited to Stripe for payment processing, WooCommerce for e-commerce, Elementor for website building, and additional infrastructure providers. We do not control or endorse these third parties and are not responsible for their content, availability, privacy practices, or terms of service. Your use of third-party services is subject to their respective terms and privacy policies.
We reserve the right to modify, suspend, or discontinue the Website or any of our services at any time. We may update these Terms periodically. Continued use of the Website or any service after updated Terms are posted constitutes your acceptance of the revised Terms. For active subscribers, material changes will be communicated via email where possible with reasonable advance notice.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Worcester County, Massachusetts.
